3. Hosting und Server-Logfiles (Shopify)

Unser Onlineshop wird über die Plattform Shopify betrieben (Shopify International Limited, Irland, sowie Shopify Inc., Kanada). Shopify stellt die technische Infrastruktur bereit und verarbeitet dabei personenbezogene Daten in unserem Auftrag.

Bei jedem Aufruf unserer Website werden automatisch Informationen erfasst (Server-Logfiles), u. a.:

  • IP-Adresse des zugreifenden Geräts
  • Datum und Uhrzeit des Zugriffs
  • aufgerufene Seiten/Dateien
  • verwendeter Browser und Betriebssystem
  • Referrer-URL

Rechtsgrundlage: Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an einem sicheren und stabilen Betrieb der Website).

5. Bestellung und Vertragsabwicklung

Wenn Sie in unserem Shop bestellen, verarbeiten wir die zur Vertragsabwicklung erforderlichen Daten, insbesondere:

6. Zahlungsabwicklung über PayPal

Für die Zahlungsabwicklung nutzen wir PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxemburg). Wenn Sie mit PayPal bezahlen, werden die für die Zahlung erforderlichen Daten (z. B. Name, Adresse, Zahlungsbetrag, ggf. Zahlungsdaten) an PayPal übermittelt. Die Verarbeitung durch PayPal erfolgt nach dessen eigener Datenschutzerklärung.

Zusätzlich bieten wir Kartenzahlung über Shopify Payments an (Shopify International Limited, Irland). Wenn Sie per Karte bezahlen, werden die für die Zahlung erforderlichen Daten (z. B. Name, Rechnungsadresse, Kartendaten, Zahlungsbetrag) an Shopify Payments bzw. dessen Zahlungsdienstleister übermittelt und dort verarbeitet.

7. Versand über DHL

Zur Lieferung Ihrer Bestellung geben wir Ihre Versanddaten (Name, Lieferadresse, ggf. E-Mail-Adresse/Telefonnummer für die Sendungsverfolgung) an unseren Versanddienstleister DHL (DHL Paket GmbH / Deutsche Post DHL Group) weiter.

8. Newsletter / E-Mail-Marketing (Shopify Email)

Wenn Sie sich für unseren Newsletter anmelden, verwenden wir Ihre E-Mail-Adresse, um Ihnen Informationen und Angebote zuzusenden. Der Versand erfolgt über Shopify Email. Die Anmeldung erfolgt im Double-Opt-In-Verfahren, d. h. Sie erhalten nach der Anmeldung eine Bestätigungs-E-Mail.

Sie können den Newsletter jederzeit über den Abmeldelink in jeder E-Mail oder per Nachricht an contact@vaydore.com abbestellen. Der Widerruf berührt nicht die Rechtmäßigkeit der bis dahin erfolgten Verarbeitung.

9. Weitergabe von Daten / Auftragsverarbeiter

Eine Weitergabe Ihrer personenbezogenen Daten an Dritte erfolgt nur, soweit dies zur Vertragsabwicklung erforderlich ist, Sie eingewilligt haben oder eine gesetzliche Grundlage besteht. Zu unseren Auftragsverarbeitern bzw. Empfängern zählen insbesondere:

  • Shopify (Hosting und Betrieb des Onlineshops)
  • PayPal (Zahlungsabwicklung)
  • DHL (Versand)
  • Shopify Email (Newsletterversand)
  • Shopify Payments (Kartenzahlung)

Mit unseren Auftragsverarbeitern haben wir, soweit erforderlich, Verträge zur Auftragsverarbeitung (Art. 28 DSGVO) geschlossen.

10. Datenübermittlung in Drittländer

Einige der von uns eingesetzten Dienste (insbesondere Shopify und PayPal) können Daten auch außerhalb der Europäischen Union bzw. des Europäischen Wirtschaftsraums, u. a. in die USA und nach Kanada, übermitteln oder dort verarbeiten. Soweit eine Übermittlung in ein Drittland erfolgt, stützen wir diese auf geeignete Garantien im Sinne der Art. 44 ff. DSGVO, insbesondere die Standardvertragsklauseln der EU-Kommission bzw. einen Angemessenheitsbeschluss, sofern ein solcher vorliegt.

11. Speicherdauer

Wir verarbeiten und speichern Ihre personenbezogenen Daten nur so lange, wie dies für die Erfüllung der jeweiligen Zwecke erforderlich ist oder gesetzliche Aufbewahrungsfristen (insbesondere handels- und steuerrechtliche Fristen von bis zu 10 Jahren) dies vorschreiben. Nach Wegfall des Zwecks bzw. Ablauf der Fristen werden die Daten gelöscht.

3. Hosting and Server Log Files (Shopify)

Our online store is operated on the Shopify platform (Shopify International Limited, Ireland, and Shopify Inc., Canada). Shopify provides the technical infrastructure and processes personal data on our behalf in doing so.

Each time our website is accessed, information is automatically recorded (server log files), including:

  • IP address of the accessing device
  • Date and time of access
  • Pages/files accessed
  • Browser and operating system used
  • Referrer URL

Legal basis: Art. 6(1)(f) GDPR (legitimate interest in the secure and stable operation of the website).

4. Cookies

Our website uses cookies that are technically necessary for the operation of the store (e.g. shopping cart, login, security). Legal basis: Art. 6(1)(f) GDPR and Section 25(2) TDDDG (technically necessary cookies).

5. Orders and Contract Processing

When you place an order in our store, we process the data required to perform the contract, in particular:

  • First and last name
  • Billing and delivery address
  • Email address
  • Telephone number, where applicable
  • Order and payment data

We use this data to process your order, arrange delivery, handle payment and communicate with you.

6. Payment Processing via PayPal

We use PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg) for payment processing. If you pay using PayPal, the data required for the payment (e.g. name, address, payment amount and, where applicable, payment details) is transmitted to PayPal. PayPal processes this data in accordance with its own privacy policy.

In addition, we offer card payments via Shopify Payments (Shopify International Limited, Ireland). If you pay by card, the data required for the payment (e.g. name, billing address, card details, payment amount) is transmitted to and processed by Shopify Payments or its payment service providers.

7. Shipping via DHL

In order to deliver your order, we pass on your shipping data (name, delivery address and, where applicable, email address/telephone number for shipment tracking) to our shipping service provider DHL (DHL Paket GmbH / Deutsche Post DHL Group).

8. Newsletter / Email Marketing (Shopify Email)

If you subscribe to our newsletter, we use your email address to send you information and offers. Newsletters are sent via Shopify Email. Subscription takes place using the double opt-in procedure, meaning that you will receive a confirmation email after signing up.

You may unsubscribe from the newsletter at any time using the unsubscribe link included in every email, or by sending a message to contact@vaydore.com. Withdrawal of consent does not affect the lawfulness of processing carried out prior to such withdrawal.

9. Disclosure of Data / Processors

Your personal data will only be disclosed to third parties where this is necessary for the performance of the contract, where you have given your consent, or where a legal basis exists. Our processors and recipients include in particular:

  • Shopify (hosting and operation of the online store)
  • PayPal (payment processing)
  • DHL (shipping)
  • Shopify Email (newsletter distribution)
  • Shopify Payments (card payments)

Where required, we have concluded data processing agreements (Art. 28 GDPR) with our processors.

10. Transfers to Third Countries

Some of the services we use (in particular Shopify and PayPal) may transfer or process data outside the European Union or the European Economic Area, including in the USA and Canada. Where a transfer to a third country takes place, we base such transfer on appropriate safeguards within the meaning of Art. 44 et seq. GDPR, in particular the European Commission's Standard Contractual Clauses or an adequacy decision, where such a decision exists.

11. Retention Period

We process and store your personal data only for as long as is necessary to achieve the respective purposes, or for as long as statutory retention periods require (in particular commercial and tax law periods of up to 10 years). Once the purpose no longer applies or the relevant periods expire, the data is deleted.
